Yordan Creatives is not a company with employees, an office, or a support desk. It is one person. That has practical consequences, stated below, and it is the reason these terms are short.

In these terms, "we", "us" and "our" mean Yordan Creatives. "You" means the person reading or using the site or the application.

2. What these terms cover

These terms cover two things:

  1. This website (yordaan.com) — the pages describing the business.
  2. The invoicing application — software operated by us that turns recorded work into invoices. It is described in section 3.

By using either, you accept these terms. If you do not accept them, do not use the site or the application.

3. What the invoicing application is, and what it is not

The application is a tool for freelancers whose work arrives as shifts on a schedule. It reads a work schedule, lets the operator record the days worked, and produces an invoice as a PDF. It can store those PDFs in the operator's own Google Drive and email them from the operator's own Gmail account.

It is in development. At the time of writing:

  • there are no customers;
  • there is no sign-up, and registration is disabled;
  • it is operated on a single account by the owner of this business.

It is offered as it stands, for evaluation and for the owner's own use. Features may change, break, or be withdrawn without notice. We do not promise that it will be available at any particular time, and we do not offer a service level.

If the application is later offered to other users, these terms will be replaced by terms that describe that service, and the new terms will be published here.

4. Invoices are generated from the operator's own records

Every invoice the application produces is built from data entered by the operator and, where connected, from the operator's own calendar and the schedule feed of the operator's client.

The application does not verify that work was carried out. It does not file anything with the Belastingdienst or any other authority. It does not decide VAT treatment, and nothing it produces is tax advice. The operator remains responsible for:

  • the accuracy of every invoice;
  • the invoice number, the date, the amounts and the description;
  • the VAT treatment applied, including any reverse charge (btw verlegd) and the statement printed on the invoice;
  • meeting the invoice requirements that apply to the operator's own business.

An invoice issued through the application has the same legal weight as one typed by hand, and the same consequences. Check it before it leaves your hands.

5. Acceptable use

You may use this website and the application only for lawful purposes. You must not:

  • access, or try to access, an account that is not yours;
  • probe, scan or test the security of the application, or attempt to break its authentication, except with our written permission;
  • copy, scrape, or place a load on the site or the application;
  • use the application to produce an invoice for work that was not done, or to record a VAT treatment that does not apply;
  • interfere with another person's use of the service;
  • reverse engineer or decompile the application, except to the extent that the law allows despite this restriction.

We may suspend or end access if these rules are broken, or if use of the service is unlawful. Where it is reasonable to do so, we will say why.

6. Content on this website

The descriptions on this site are general. Project locations are listed as a record of work carried out, not as an offer, and not as a claim about any current or future contract. Nothing on this site is an offer capable of acceptance; work is agreed in writing, per project.

7. No warranty

The site and the application are provided "as is" and "as available". To the extent the law allows, we give no warranty that:

  • the application will be uninterrupted, timely or free of errors;
  • an invoice it produces will satisfy the requirements of a particular client, authority or country;
  • the site's content is complete or current.

This does not affect any right you have under mandatory law, including the statutory rights of a consumer.

8. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, lost profit, lost revenue, lost data, business interruption, or damage to reputation;
  • we are not liable for fines, tax assessments, interest or penalties imposed on you by a tax authority as a result of an invoice you issued or a record you kept;
  • our total liability for any claim connected to the application is limited to the amount you paid us for it in the twelve months before the claim arose; where you paid nothing, it is limited to €500.

These limits do not apply to liability that cannot be excluded by law, including liability for intent or deliberate recklessness (opzet of bewuste roekeloosheid), and liability for death or personal injury.

9. Your data

How personal data is handled is set out in the privacy policy. That policy forms part of these terms.

Data you enter into the application remains yours. Where the application writes a file to a connected Google account, that file is stored in the account you connected, under your control.

10. Changes

We may change these terms. The current version is always on this page, with the date at the top. If a change materially affects users of the application, we will say so on this page before it takes effect.

11. Governing law and disputes

These terms are governed by the law of the Netherlands.

Disputes that cannot be resolved by contact will be brought before the court in Amsterdam (Rechtbank Amsterdam), unless the law requires a different court. If you are a consumer, this does not take away the protection of the mandatory rules of the country where you live, including your right to bring a claim in your local court.
